1. Acceptance of These Terms

 

Welcome to the website of Humanitarian Action of Hope, Inc. (“HAH,” “we,” “us,” or “our”), a Texas nonprofit corporation and federally tax-exempt 501(c)(3) public charity (EIN: 41-2650196).

These Terms & Conditions (“Terms”) govern your access to and use of the website at hahope.org (the “Website”), as well as your participation as a donor, volunteer, partner, beneficiary, event attendee, or supporter of HAH (collectively, the “Services”). By accessing the Website or engaging with HAH, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Website or our Services.

2. About Humanitarian Action of Hope

 

HAH is a Texas nonprofit corporation incorporated on November 15, 2025 (Texas SOS File Number 806306434), recognized by the Internal Revenue Service as a 501(c)(3) public charity. Our mission is to alleviate human suffering through compassionate action and sustainable solutions. We carry out this mission through four core programs:

  • International Humanitarian Partnerships in Africa, in collaboration with GAAM ASBL in Kinshasa, Democratic Republic of the Congo;

  • Emergency Relief and Humanitarian Aid;

  • Community Development and Empowerment;

  • Compassionate Care and Community Outreach.

HAH has earned the Candid Platinum Transparency 2026 Seal, reflecting our commitment to financial accountability and operational transparency.

3. Eligibility

 

By using the Website or engaging with our Services, you represent and warrant that:

  • You are at least 18 years of age, or you are using the Website with the supervision and consent of a parent or legal guardian;

  • You have the legal capacity to enter into these Terms and to comply with them;

  • Your use of the Website and Services complies with all applicable laws and regulations;

  • You will provide accurate and truthful information when interacting with HAH (including in donor, volunteer, or contact forms).

We reserve the right to refuse Service, terminate accounts, remove content, or cancel transactions at our sole discretion, including in cases of suspected fraud, abuse, or violation of these Terms.

4. Donations
4.1 Charitable Contributions

HAH gratefully accepts donations from individuals, corporations, foundations, and other entities. All donations to HAH support our charitable mission and are used at the discretion of our Board of Directors and management to advance our programs and operations, in accordance with our governing documents and applicable law.

4.2 Tax-Deductibility

HAH is a 501(c)(3) public charity, and contributions to HAH are tax-deductible to the fullest extent permitted by U.S. law (EIN: 41-2650196). Donors will receive a written acknowledgment for any single contribution of $250 or more, as required by IRS regulations, and may receive acknowledgment for smaller gifts as well. Donors are responsible for retaining documentation of their gifts and for consulting their own tax advisors regarding the deductibility of any specific donation. HAH does not provide tax, legal, or financial advice.

4.3 Donation Processing

Online donations are processed through our third-party donation platform, Crowded (collect.crowded.me), which handles payment information in accordance with industry-standard security practices. HAH does not store complete payment card numbers or bank account credentials on our systems. By making an online donation, you agree to the terms of service of our payment processor in addition to these Terms.

4.4 Designated and Restricted Gifts

Donors may designate gifts for a specific program or purpose consistent with our charitable mission. HAH will use designated gifts as requested, provided the designation is consistent with our charitable mission and lawful operation. If a designated purpose becomes impractical, impossible, or no longer consistent with our mission, HAH reserves the right — consistent with applicable law and our governing documents — to redirect the funds to a similar purpose.

4.5 Recurring Donations

Recurring donations will continue at the frequency and amount selected at the time of setup until canceled by the donor. You may modify or cancel a recurring donation at any time by contacting us at hah.contact1@gmail.com or through your account on the donation platform.

4.6 Refunds

Charitable donations are generally non-refundable. However, if you believe a donation was made in error (for example, an incorrect amount, duplicate transaction, or unauthorized charge), please contact us within thirty (30) days of the transaction at hah.contact1@gmail.com. We will review refund requests in good faith and on a case-by-case basis. Refunds, where granted, will be issued to the original payment method.

4.7 Anti-Fraud and Compliance

HAH complies with all applicable U.S. anti-money-laundering, anti-terrorism, and sanctions laws, including those administered by the Office of Foreign Assets Control (OFAC). We reserve the right to decline or refund any donation that we determine, in our sole discretion, may violate applicable law or our policies.

5. Volunteers and Program Participation

 

HAH welcomes volunteers and program participants who share our commitment to humanitarian service. Volunteer opportunities and program participation are subject to the following:

  • Volunteers must complete any required onboarding, training, or background checks as determined by HAH;

  • Volunteers serve at the discretion of HAH and may be reassigned or released at any time;

  • Volunteers are not employees of HAH and do not receive wages, benefits, or workers’ compensation, except where required by law;

  • Volunteers and program participants are expected to follow HAH’s code of conduct, treat all individuals with dignity and respect, and adhere to all safety and operational guidelines provided by HAH and its partners;

  • Volunteers participating in international programs (including programs in the Democratic Republic of the Congo) are responsible for obtaining valid travel documents, vaccinations, and any other requirements for international travel.

6. Use of the Website

 

6.1 Permitted Use

You may use the Website for lawful, personal, and noncommercial purposes consistent with these Terms. You may not use the Website in any way that could damage, disable, overburden, or impair the Website or interfere with any other party’s use of the Website.

6.2 Prohibited Conduct

You agree not to:

  • Use the Website to violate any applicable law or regulation;

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

  • Submit false, misleading, or fraudulent information (including in donor or contact forms);

  • Attempt to gain unauthorized access to the Website, any HAH systems, or other users’ accounts;

  • Use any automated means (such as scripts, bots, or scrapers) to access the Website without our written permission;

  • Upload or transmit any virus, malware, or other harmful code;

  • Engage in any activity that interferes with HAH’s charitable mission, defrauds HAH or its donors, or harms HAH’s reputation;

  • Use the Website for any commercial purpose without our prior written consent.

7. Intellectual Property

 

7.1 HAH Content

All content on the Website — including text, graphics, logos, images, photographs, videos, and other materials (“Content”) — is owned by HAH or licensed to HAH and is protected by U.S. and international copyright, trademark, and other intellectual property laws. The names “Humanitarian Action of Hope,” “HAH,” and our logos are trademarks of HAH.

7.2 Limited License

HAH grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, noncommercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, or commercially exploit any Content without HAH’s prior written permission, except that you may share links to our Content on social media, and you may use HAH materials for educational or news-reporting purposes consistent with U.S. fair use principles, with appropriate attribution to HAH.

7.3 User Submissions

If you submit any content to HAH (for example, comments, photos, testimonials, or stories), you grant HAH a perpetual, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, publish, and display that content in connection with our charitable mission, including in fundraising appeals, impact reports, social media, and educational materials, with or without attribution. You represent that you own or have the right to grant this license, and that the content does not violate any third-party rights or applicable law.

8. Photo, Video, and Media Release

 

HAH may take photographs or video recordings at events, programs, and activities to document and share our work. By participating in HAH events, programs, or volunteer activities, you consent to being photographed or recorded and to HAH’s use of those images and recordings for charitable, educational, fundraising, and promotional purposes, including on our Website, social media, printed materials, and partner communications.

If you do not consent to being photographed or recorded, please notify HAH staff at the event or contact us at hah.contact1@gmail.com in advance, and we will make reasonable efforts to accommodate your preference. Parents and guardians of minors should communicate any preferences regarding their child’s participation in photographs or recordings.

9. Third-Party Links and Services

 

The Website may contain links to third-party websites, services, or content (including our donation processor, social media platforms, and partner organizations) that are not owned or controlled by HAH. HAH is not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of third-party sites and services is at your own risk and subject to those parties’ terms and policies.

10. Disclaimers

 

THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

HAH does not warrant the accuracy, completeness, or reliability of any Content, and does not provide tax, legal, financial, medical, or professional advice. Information on the Website is provided for general informational purposes only and should not be relied upon as a substitute for professional advice.

11. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY LAW, HAH AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES, EVEN IF HAH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL HAH’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE DONATED TO HAH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

12. Indemnification

 

You agree to indemnify, defend, and hold harmless HAH and its directors, officers, employees, volunteers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website or Services; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any content you submit to HAH.

13. Governing Law and Dispute Resolution
 
13.1 Governing Law

These Terms and any disputes arising out of or related to them or your use of the Website or Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles.

13.2 Venue

Any legal action or proceeding arising out of or related to these Terms or the Website shall be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of such courts.

13.3 Informal Resolution

Before filing a claim against HAH, you agree to attempt to resolve the dispute informally by contacting us at hah.contact1@gmail.com. We will attempt in good faith to resolve any dispute informally within thirty (30) days of receiving notice.

14. Changes to These Terms

 

HAH reserves the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of these Terms and, where appropriate, provide additional notice on our Website. Your continued use of the Website or Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Termination

 

HAH reserves the right to suspend or terminate your access to the Website or Services, with or without notice, for any reason, including violation of these Terms. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive termination.

16. Miscellaneous
 
16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HAH regarding your use of the Website and Services and supersede any prior agreements.

16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

16.3 No Waiver

HAH’s failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or of HAH’s right to enforce it in the future.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without HAH’s prior written consent. HAH may assign these Terms in connection with a merger, dissolution, or transfer of HAH’s charitable assets to another 501(c)(3) public charity, consistent with our governing documents and IRS requirements.

16.5 No Agency or Partnership

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and HAH.
